How to Prepare for a Healthy Remarriage in Illinois

After an emotionally challenging divorce, the idea of finding a new partner can give you hope for a happier future. However, entering into a new relationship, and especially getting remarried, is a major decision that you should not take lightly, as it will significantly impact you, your children, your ex-spouse, your new partner, and his or her family. As you consider beginning a new romantic relationship after your divorce, here are some suggestions that can help you keep your priorities straight:

  • Make sure you are ready: It may be tempting to start dating as soon as possible after your divorce, but it can be difficult to begin a healthy new relationship if you are not emotionally ready. Make sure that you can be fully present for a new partner, and certainly make sure that your divorce is finalized before attempting to remarry.  

  • Focus on your children: A new relationship can be hard on your kids, who may be concerned about getting along with your new partner and his or children, moving into a new home, or being caught in a conflict between you and your ex. Do your best to listen to your children’s concerns, make sure a relationship is serious before you introduce a new partner to them, and be sure not to neglect your relationship with your children for your new companion.

  • Consider a prenuptial agreement: After having experienced the division of property in your divorce, you may find it more important to get a prenuptial agreement for your second marriage so that you and your new partner start with a clear understanding and transparency surrounding your finances, including your assets and property.

  • Understand the impact on your divorce agreement: In Illinois, remarriage can affect your divorce agreement in a few different ways. For example, if you receive spousal support from your ex, those payments will end upon your remarriage or cohabitation. If you plan to move to a new location for your new partner, you may also need to modify your parenting plan and obtain court approval for relocation depending on the distance.
