The first thing to determine when adopting relatives is if it will be an open or closed adoption. With an open adoption, the birth parents can still communicate with the child; while in a closed adoption, the birth parents give up their right to interact with the child and adoptive family. Another important consideration is the location of the parties involved. If everyone lives in Illinois, a more streamlined process may be available than if the parties involved reside in different states. If the adoptive parents and child live in different states, the more complex Interstate Compact on the Placement of Children (ICPC) process must be followed.

In the case of stepparent adoptions, the parental rights of the other biological parent must be terminated before a stepparent can adopt the child of his/her spouse. If the other parent does not consent to the adoption, you must establish grounds for termination of parental rights. Potential grounds may include:

  • Abandonment;
  • Statutory neglect;
  • Desertion for at least three months prior to beginning the adoption process;
  • Failure to pay child support despite having the financial means to do so;
  • Failure to make a reasonable effort to become part of the child's life;
  • Physical abuse.
